    • Period 1 – App On, No Ride Accepted: Once the driver is logged in and waiting for a ride request, Uber/Lyft provide limited liability coverage in case of an at-fault accident. In California, typically $50,000 per person, $100,000 per accident for bodily injury, and $30,000 for property damage, plus $200,000 excess liability coverage. Personal insurance may deny claims due to commercial use exclusions, so Uber’s contingent coverage may step in.

    • Periods 2 & 3 – Ride Accepted and Passenger On Board: From the moment a driver accepts a ride request and is en route to the passenger, and throughout the trip with the passenger, Uber and Lyft provide their full commercial insurance coverage. Full commercial auto insurance with $1 million liability coverage and $1 million uninsured/underinsured motorist coverage protects passengers and others injured due to the Uber driver’s fault. This coverage may also include vehicle damage and injury protections for driver and passengers.

    If injured as an Uber passenger, you’re typically covered under the $1 million policy during the ride or pickup. For others hit by an Uber, coverage depends on whether the driver was off-duty, waiting for a ride, or actively driving with a passenger. Rideshare companies maintain digital records (app timestamps, GPS) to verify driver status and applicable coverage.

    Rideshare accidents often involve multiple insurers, Uber’s, the other driver’s, and possibly your own, each potentially disputing liability or coverage. Given Uber and Lyft drivers are independent contractors, the companies usually avoid direct liability but must provide mandated insurance.
